This course addresses specialised problems arising in the practice of international arbitration.

This year’s edition of the course will be devoted to problems related to the conduct of arbitration proceedings (case management, terms of reference, procedural timetable, procedural orders, taking of evidence, expert witnesses, hearings, applicable rules of law, expedited procedures, confidentiality, etc.) and the making of the award (final, partial and interim awards, scrutiny of the award, award by consent, correction and interpretation, decision as to the costs etc.). The course will include case discussions and relies on contributions by experienced counsel and arbitrators.

Programme

Day 1 (Thursday May 12)
Morning, 9.15 a.m. – 12.15 p.m.
- Key issues in drafting of arbitration clauses
- Selection of the arbitrators (criteria to be considered, interviews etc)
- Challenge of arbitrators (lack of independence and/or impartiality; including introduction to the IBA Guidelines on Conflict of Interest)

Afternoon, 14.15 p.m. – 16.45 p.m.
- Introduction to the conduct of arbitration proceedings, terms of reference, case management conference, “Procedural Order No. 1”, procedural timetable
- Mock Case Management Conference


Day 2 (Friday 13 May)
